Acceptance of Terms
Welcome to Forge Performance Lab. These Terms of Service (“Terms”) govern your use of our website (forgeperformancelab.com) and our training services. By accessing our website or enrolling in our programs, you agree to be bound by these Terms.
If you do not agree with any part of these Terms, you may not use our services. If you are under 18 years old, your parent or legal guardian must review and agree to these Terms on your behalf.
Services Offered
Forge Performance Lab provides:
- Basketball skills training
- Sports performance training (strength, speed, power, agility)
- Injury prevention and sports medicine services
- VALD performance assessments and progress tracking
- Team training programs
- Private coaching sessions
All services are provided at our facility in Northwest Arkansas and are subject to availability, scheduling, and program requirements.
Membership and Enrollment
Program Tiers
We offer three primary membership tiers:
- Foundation Program – Entry-level training
- Fire Program – Intermediate development
- Steel Program – Advanced elite training
Each tier has specific requirements, pricing, and benefits as outlined in our program materials.
Enrollment Process
- Complete a waitlist signup or assessment booking form
- Attend a free VALD performance assessment (if applicable)
- Review program options and pricing with our staff
- Complete enrollment paperwork and payment setup
- Attend orientation and begin training
Founding Member Program
Founding members receive:
- Discounted monthly pricing locked in for life
- Priority scheduling and exclusive events
- Early access to new programs and services
Founding member pricing is available to the first 90 members only (30 per tier) and is non-transferable.
Payment Terms
Pricing and Fees
- Monthly membership fees range from $250-$450 depending on program tier
- Founding members receive reduced pricing (specific rates provided at enrollment)
- Prices are subject to change for new members; existing member rates are locked in
- All fees are in U.S. dollars
Payment Methods
- We accept credit cards, debit cards, and ACH bank transfers
- Monthly fees are charged automatically on the 1st of each month
- Payment information must remain current; failed payments may result in suspension of services
Refund Policy
- Monthly Memberships: No refunds for partial months; cancel anytime with 30 days’ notice
- Free Assessments: No-shows without 24-hour notice forfeit the free assessment
- Program Fees: Non-refundable once training begins
- Special Circumstances: Refunds for injury, relocation, or extenuating circumstances reviewed case-by-case
Cancellation and Termination
Member-Initiated Cancellation
- You may cancel your membership at any time with 30 days’ written notice
- Notice must be submitted via email to andy@forgeperformancelab.com
- You will be charged for the full 30-day notice period
- Founding member pricing cannot be reinstated if you cancel and return later
Forge-Initiated Termination
We reserve the right to terminate your membership immediately if you:
- Violate these Terms of Service
- Engage in unsafe, disruptive, or inappropriate behavior
- Fail to pay fees after multiple notices
- Provide false information during enrollment
Terminated members are not entitled to refunds for unused time.
Assumption of Risk and Liability Waiver
Inherent Risks
Athletic training and sports performance activities carry inherent risks, including but not limited to:
- Muscle strains, sprains, and injuries
- Falls, collisions, and accidents
- Cardiovascular stress and overexertion
- Equipment-related injuries
By participating in Forge programs, you acknowledge these risks and assume full responsibility for any injuries or damages that may occur.
Release of Liability
To the fullest extent permitted by law, you release and hold harmless Forge Performance Lab, its owners, employees, coaches, contractors, and affiliates from any and all claims, damages, losses, or expenses arising from your participation in our programs, except in cases of gross negligence or intentional misconduct.
Medical Clearance
You represent that:
- You are physically fit to participate in athletic training
- You have no medical conditions that would prevent safe participation
- You will disclose any relevant health conditions or injuries to our staff
- You will consult your physician if you have any concerns about your ability to participate
For minors, a parent or guardian must confirm the above on behalf of the athlete.
Emergency Medical Treatment
In the event of injury or medical emergency, you authorize Forge staff to:
- Provide first aid and emergency care
- Contact emergency medical services (911)
- Contact your designated emergency contacts
- Transport you to a medical facility if necessary
You are responsible for all medical expenses incurred as a result of injury or illness.
Participant Conduct
Expected Behavior
All participants must:
- Treat coaches, staff, and other athletes with respect
- Follow facility rules and coach instructions
- Arrive on time and prepared for training sessions
- Maintain appropriate hygiene and attire
- Use equipment properly and safely
Prohibited Conduct
The following behaviors are strictly prohibited:
- Bullying, harassment, or discrimination of any kind
- Violence, threats, or intimidating behavior
- Use of drugs, alcohol, or tobacco on premises
- Theft, vandalism, or property damage
- Unsafe use of equipment or disregard for safety protocols
Violation of conduct rules may result in suspension or termination without refund.
Intellectual Property
Our Content
All content on our website and in our programs—including text, graphics, logos, videos, training methodologies, and assessment protocols—are the property of Forge Performance Lab and are protected by copyright, trademark, and other intellectual property laws.
You may not:
- Reproduce, distribute, or publicly display our content without permission
- Use our training methodologies for commercial purposes
- Copy or share proprietary assessment protocols or data
Your Content
By providing testimonials, photos, videos, or other content to Forge, you grant us a perpetual, royalty-free license to use, reproduce, and display that content for marketing and promotional purposes. You represent that you have the right to grant this license and that the content does not violate any third-party rights.
Privacy and Data Protection
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.
VALD Assessment Data
Data Ownership
Performance assessment data generated through VALD technology is owned by Forge Performance Lab. However, you have the right to:
- Access your personal assessment data
- Request copies of your progress reports
- Request deletion of your data (subject to legal retention requirements)
Data Use
We use your assessment data to:
- Create personalized training programs
- Track your progress over time
- Generate progress reports for you and your parents/guardians
- Conduct anonymized research on training effectiveness
- Improve our programs and services
Data Sharing
We do not share your individual performance data with third parties except:
- With your explicit consent (e.g., sharing with school coaches, recruiters)
- As required by law or legal process
- In anonymized form for research purposes
Photography and Video Release
We frequently capture photos and videos at our facility for:
- Progress tracking and athlete development
- Social media marketing
- Website and promotional materials
- Internal training documentation
By enrolling, you grant permission for such photography and videography unless you specifically opt out in writing. You may opt out at any time by contacting andy@forgeperformancelab.com.
For minors, parents/guardians grant this permission on behalf of the athlete.
Disclaimers and Limitations of Liability
No Guarantees
While we are committed to delivering high-quality training and measurable results, we cannot guarantee:
- Specific performance outcomes (e.g., vertical jump increases)
- College recruitment or scholarship offers
- Injury-free participation
- Starting positions on school or AAU teams
Results vary based on individual effort, genetics, compliance with training protocols, and other factors outside our control.
Limitation of Liability
To the maximum extent permitted by law, Forge Performance Lab’s total liability for any claims arising from our services shall not exceed the amount you paid for services in the 12 months preceding the claim.
We are not liable for:
- Indirect, incidental, consequential, or punitive damages
- Lost opportunities (e.g., missed games, recruitment opportunities)
- Injuries sustained outside our facility or programs
- Actions of other participants or third parties
No Warranties
Our services are provided “as is” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
Indemnification
You agree to indemnify, defend, and hold harmless Forge Performance Lab and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your violation of these Terms
- Your participation in our programs
- Your negligent or wrongful conduct
- Any content you provide to us
Governing Law and Dispute Resolution
Governing Law
These Terms are governed by the laws of the State of Arkansas, without regard to conflict of law principles.
Dispute Resolution
In the event of any dispute arising from these Terms or our services:
- Informal Resolution: You agree to contact us first to attempt to resolve the dispute informally by contacting andy@forgeperformancelab.com.
- Mediation: If informal resolution fails, both parties agree to participate in good-faith mediation before pursuing litigation.
- Arbitration: If mediation is unsuccessful, disputes shall be resolved through binding arbitration in Washington County, Arkansas, in accordance with the rules of the American Arbitration Association.
- Litigation: If arbitration is unavailable or unenforceable, any legal action must be brought in the state or federal courts located in Washington County, Arkansas.
Class Action Waiver
You agree to resolve disputes with Forge on an individual basis only. You waive any right to bring or participate in class action lawsuits, class arbitrations, or representative actions.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
Entire Agreement
These Terms, together with our Privacy Policy and any program-specific agreements, constitute the entire agreement between you and Forge Performance Lab regarding our services and supersede all prior agreements or understandings.
Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website with a new “Last Updated” date. Material changes will be communicated via email to active members.
Your continued use of our services after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the changes, you must cancel your membership.
